General Terms and Conditions of Sale - Les Chambres du Waterzooi
ARTICLE 1: APPLICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE (GTCS)
These General Terms and Conditions of Sale (GTCS) apply to reservations made by the Client. Any reservation implies full and unconditional acceptance of these conditions by the Client.
ARTICLE 2: RESERVATION ORGANIZATION
For all Clients, reserved rooms are available from 3:00 PM on the day of arrival. They must be vacated by 11:00 AM on the day of departure. Any delay in departure may result in an additional night's charge at the public rate displayed.
1/ Reservations can be made directly at the hotel, by mail, email, or phone.
Except for last-minute reservations, this booking method will be confirmed by the Hotel. If the reservation is made through our partners' websites or directly with one of our partners, no confirmation from the Hotel will be sent to the Client.
2/ To finalize the reservation, whether last-minute or not, the Client must guarantee their booking with a credit card imprint BEFORE arrival at the Hotel.
If the reservation is made via the hotel’s website, the credit card imprint will be collected through our website.
If the reservation is made via a partner’s website, the Hotel retrieves the banking details provided by the Client on that site. In such cases, the Hotel agrees to use these details only in the event of a cancellation as specified in Article 3 of these GTCS.
ARTICLE 3: CANCELLATION
Billing is based on the services booked for the entire stay. The Client is advised to pay close attention to the cancellation conditions defined below.
1/ The following are considered cancellations:
Failure to provide a credit card imprint,
Oral or written notification of non-arrival for personal reasons,
No-show without notification,
Violation of hotel rules.
2/ Cancellations of all or part of the initial reservation must be accepted in writing by the Hotel, which may refuse modification requests without providing a reason.
Without the written acceptance of the Hotel, the reservation remains as initially booked, and the Hotel cannot be held liable for any compensation.
3/ Any stay booked or started at the Hotel is fully due according to the Client's reservation. No discount or refund will be granted in case of non-arrival or early departure at the Client’s initiative, regardless of the reason (except for the exclusions in Article 3).
5/ Cancellation deadlines:
If the cancellation occurs more than 24 hours before the stay, no charges apply.
If the cancellation occurs less than 24 hours before the stay, the full amount will be charged.
6/ Exemptions from the cancellation conditions:
Death of a family member: A death certificate and proof of relationship must be provided.
Hospitalization of the Client or a family member: A hospital admission certificate stating the reason for admission must be provided.
Major damage to the Client’s main residence (fire, destruction, burglary): Proof must be provided.
ARTICLE 4: RELOCATION
In the event of unavailability due to force majeure, technical issues, or other reasons, the Hotel reserves the right to relocate Clients to an equivalent category hotel with similar services. The Hotel will not be liable for any additional compensation.
ARTICLE 5: PRICES
Rates are in Euros and apply on the booking date. Prices exclude tourist tax and additional services. Rates may change due to legislative or regulatory changes affecting pricing, such as VAT modifications or new taxes. The VAT rate applied is the one in effect on the invoice date. If the number of booked rooms decreases by at least 10% compared to the initial reservation, the Client may be assigned new rates due to the reduced services.
ARTICLE 6: PAYMENT TERMS
1/ Deposit: For group bookings, payment must be made by phone via credit card, by mail via check, or by direct bank transfer. For reservations made through partner sites where online payment is not possible, the Hotel will collect credit card details, which will only be used in case of cancellation as specified in Article 3.
2/ Balance: For hotel rooms, payment must be made no later than the departure date. Payments can be made in cash, by check, credit card, or holiday vouchers.
3/ Default of payment: In case of late payment, penalties of 15% per year will apply from the day after the due date, calculated on the total invoice amount including VAT. Additionally, a fixed compensation of €40 excluding VAT per invoice will be required, plus any further costs incurred in case of litigation. Payments made more than 60 days after invoice issuance are legally considered abusive and subject to legal action.
ARTICLE 7: TRANSPORTATION
The Hotel does not provide any transportation services and is not responsible for any transportation issues (delays, cancellations, etc.).
ARTICLE 8: CLIENT MISCONDUCT AND DAMAGE
Clients must use the room responsibly. Any behavior contrary to public order or good morals may result in eviction without compensation or refund.
1/ Security deposit: A credit card imprint is required at check-in to cover potential damages to the rented property.
2/ Additional persons: Clients may not bring additional guests without the Hotel's express permission. Unauthorized guests may result in full stay charges or refusal of service.
ARTICLE 9: INSURANCE - DAMAGE - BREAKAGE - THEFT
Clients must have liability insurance covering any damages during their stay. The Hotel is not responsible for damages, fire, or theft affecting Clients' belongings. Clients and their insurers waive any claims against the Hotel for any direct or indirect damages.
ARTICLE 10: PETS
Pets are allowed upon the Hotel's approval and subject to an additional charge.
ARTICLE 11: SMOKING POLICY
Smoking is strictly prohibited in the hotel and chalets, in compliance with the law of January 2, 2008. A €250 fine will apply for any violation.
ARTICLE 12: LIABILITY
The Hotel is not liable for structural changes such as sale or closure. Photos on the website are non-contractual. While efforts are made to ensure accuracy, variations may occur due to renovations or furniture changes. Clients cannot claim compensation for such discrepancies.
